AUSTIN -- Like a grade-B horror movie that didn't warrant a sequel (but got one anyway), the City of Austin is at it again with its most objectionable, distasteful project in years. Activists, dressed as vampires in generic police uniforms, will gather for the third year this Halloween night in downtown Austin to protest the Austin Police Department's "No Refusal Weekends" policy and officer-administered blood draws.

"What makes 'No Refusal Weekends' so offensive”, said Heather Fazio of Texans for Accountable Government, “is that Austin's chief of police, Art Acevedo, and the Austin Police Department presume they have the authority to usurp, not only the Texas Transportation Code, but the US Constitution as well, which guarantees the people's right to Due Process. Rubber stamped warrants do NOT qualify as due process."

Texas Law allows blood samples to be taken from DWI suspects over their refusal only under narrowly defined circumstances. During "No Refusal Weekends", search warrants are approved in a highly expedited manner, permitting the drawing of blood despite statutory provisions in the Texas Transportation Code (section 724).

Last year, a coalition led by Texans for Accountable Government ("TAG") and including the Travis County Republican, Democratic and Libertarian parties, endorsed and advocated a resolution before the City Council to oppose the blood draws. But that story didn't have a happy ending, as the resolution was gutted to allow for the vampiric practice.

Aside from protesting the bad policy, Halloween protesters are advocating community solutions to the DWI problem. One solution is the Square Patrol (squarepatrol.org, 512-R-U-DRUNK), whose aim is to provide sober rides home for intoxicated revelers. Another is supporting the practice of appointing a designated driver when partying in groups.

"TAG recognizes that in Austin there is a problem with people drinking and driving. However, rather than using the force of the state to try and curb this problem by stripping law-abiding citizens of their INALIENABLE rights, we advocate for community solutions such as Square Patrol. TAG’s calling for community, NOT coercion", said Executive Director John Bush.

PRESS AVAILABILITY

TAG officers are available for comment on cost-effective solutions to the drunk driving problem in Austin that respect the rights of the individual and free up police to keep a greater number of people safe via the contact information above. Print, broadcast, and new media inquiries are all welcome. In addition, TAG will host a press conference prior to the downtown march at 9:00pm.
