To me the judge shouldn't be doing it for any reason, regardless of if he thinks it's silly or not.

Yeah, but I still think that the judge just did it to throw it in their faces that no matter what brand of woo woo they were foisting, it wasn't going to be a legit defense.

She is getting an addition stipulation that other people in a similar situation wont get, simply based on her religious belief. We all know it doesn't matter in the end because we are all sane and know he isn't coming back, however she gets a little extra because of what she believes that someone who doesn't believe their kid is coming back doesn't get. Why should she get even that little extra.

But how does that "BENEFIT" her in court? It doesn't benefit her, because he isn't coming back to life! So ... really it's just in jest, or as others said, to convince her to plead guilty. I don't see the resurrection clause as "benefiting" her.

Besides, doesn't such a clause already exist? If I were convicted of murder, if it was suddenly discovered that my son was alive, the ruling of murder couldn't stand! Well, I assume I'd still be guilty of attempted murder, but the murder conviction couldn't stand - hence a need for a new trial.

Why should it matter what the accused is convinced of or not. If I killed my mother because I was convinced she was a demon it shouldn't make one bit of difference in my punishment (unless I'm determined insane). If I starved my child because I thought he was a pain in the ass would I be able to get the same ruling in my favor that if he came back to life I'd be free? We all know it doesn't really matter because this kid isn't coming back but why should her religious beliefs benefit at all in court? It shouldn't.

Because in other cases the accused is not generally convinced that the victim will come back to life, and trying to make that deal wouldn't get you anywhere.

If that is the case I find it pretty sad. Why not a prevision for all murder cases that the killer is to be released if their victim comes back to life?

Honestly, I think I'd agree to to it too, if for no other reason than to humor her into pleading guilty.

I think this is the case where the judge agreed ( I'm betting he did this as a dare ) to terms that require her to be released if the child is resurrected.  Amazing.

I am sorry to announce that I am unable to find a place in the area.  All the places I've checked do not have meeting rooms and the public library is booked through May.    Who knew it would take more than 96 hours to find a meeting place?

I'll get a place next month.

Again, I apologize for letting you down.
