It is technically suppose to be legendary, but I would make the deck anyway.  I don't know anyone in our group that would really have a problem with this.  We would just treat it like a legendary creature.  Only real suggestion I will make is to have a legendary creature around in case someone does have a problem with it.  Also, you should let people know that your creature isn't a legend when you start to play with new people.

Other than that, good luck.  I made a forum post a while back with a lot of links to resources if you would like any help.
