It is technically suppose to be legendary, but I would make the deck anyway. I don't know anyone in our group that would really have a problem with this. We would just treat it like a legendary creature. Only real suggestion I will make is to have a legendary creature around in case someone does have a problem with it. Also, you should let people know that your creature isn't a legend when you start to play with new people.

I have been thinking about putting together my first EDH deck and have a creature that I think would make an interesting commander, but is not legendary (Tamanoa). Can I still use him as my commander (at least for casual play) or is the commander actually required to be legendary?
