Please join New York In-House Counsel and our host, Holland & Knight, for a review of hot topics in Bankruptcy and Restructuring.
Bankruptcy partner, Barbra Parlin, and bankruptcy litigator, Warren Gluck, will lead the discussion, which will cover:
• International debt enforcement and fraud investigation: the latest trends and game-changing law - including (i) "intermediary bank discovery," which can reveal a target's global transaction history, counterparties, and worldwide accounts, and (ii) the "location" of property in the 21st century - global asset freezes issuable by New York courts and the increased importance of New York jurisdictional clauses to decrease counterparty risk.
• Cross border insolvency statutes, their uses and limitations, including: (i) foreign-law based clawback actions in US courts; (ii) jurisdiction and conflict of laws issues; (iii) extra territorial application of US law and enforceability of US judgments in foreign jurisdictions.
• Failed leveraged buyouts, creditor clawback actions and the securities safe harbor end run: what Tribune and Lyondell mean for shareholders facing cash outs.
Registration begins at 6:00 PM.
The presentation will be given from 6:30 to 8:00, and a networking cocktail reception hosted by the firm will follow!
This program is approved for one and one half (1.5) hours of New York CLE credit.
