ASSUMPTION OF RISK, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY and PLEASE PRINT A COPY FOR YOUR RECORDS

Seattle Eastside Ski and Snowboard Meetup designates a variety of activities both on and off the mountain for skiers who have joined the meetup and would like to share rides up to mountain resorts voluntarily.

By clicking on the JOIN button to become a part of the Seattle Eastside Ski and Snowboard Meetup you not only agree to the Terms and Conditions of the Meetup system but you agree to this ASSUMPTION OF RISK, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT.

Users of Seattle Eastside Ski and Snowboard Meetup are advised that any decision to carpool to the mountains with others in the group is voluntary and entirely at the discretion of participants.

No background checks of drivers or participants, driver record checks or insurance checks are undertaken by Seattle Eastside Ski and Snowboard Meetup, and the group does not make any assurances or certifications regarding the condition, suitability or safety of the vehicles being used by participants in the carpooling system, the reliability or driving ability of participants or drivers, or whether those participants and drivers are insured. Seattle Eastside Ski and Snowboard Meetup recommends that participants exercise caution when selecting a potential carpool partner. Members should not accept rides or give rides to complete strangers. NEVER get in a vehicle/carpool with someone you have just met. NEVER accept offers for free stays or shares in condos or hotel rooms of trip participants that you have not spent time getting to know before the event.

By deciding to voluntarily give a ride or share a ride and carpool up to the mountains, you are agreeing that you are entirely responsible for your own safety while driving to and from the resort.

Seattle Eastside Ski and Snowboard Meetup assumes no responsibility for the accuracy, currency or reliability of the content of sites external to Seattle Eastside Ski and Snowboard Meetup website.

Participants Drivers/Riders. Responsibility for Insurance
It is the responsibility of individuals participating in a carpool/ride situation to:

1. To notify their insurance provider of their intent to carry non-family passengers and to ensure that they have adequate coverage to protect both themselves and their passengers.
2. It is the responsibility of the individual accepting a ride in a carpool to ensure that the driver of the vehicle has an acceptable driving record, is licensed accordingly and has adequate insurance to protect both driver and passengers.

Participants Drivers/Riders. Responsibility for Vehicle Maintenance

It is the responsibility of the driver to ensure that their vehicle is in good working condition and all maintenance performed in preparation for dangerous mountain driving conditions. This includes electronic stability system, brakes, engine, fluids and tires and all items pertaining to the safety of their vehicle.

All vehicles used by Seattle Eastside Ski and SnowSnowboard meetup drivers who carry passengers MUST have tires must have the M+S "all season" designation or snow tires from Oct 14-May 30 of each ski season and be checked for tire wear. Tires with OVER 20,000 miles are NOT considered safe for winter driving conditions. (If a driver does not believe the leadership of the meetup, we suggest you go to a local tire store and have them measure the tread.....they WILL tell you that you know longer have an "all season" tire and they must be replaced for MOUNTAIN DRIVING). A driver that has NOT met these conditions should NOT offer to take members in their vehicle. It is also the responsibility of the trip participant to decline a ride from a member that has an unsafe vehicle. It is the responsibility of the trip participant to ask a driver about the insurance, vehicle maintenance and driving habits of the driver before accepting a ride at their own risk.

Seattle Eastside Ski and Snowboard Meetup is in no way responsible for verifying or certifying the reliability, driving ability or insurance status of drivers and participants of day trips up to the mountains.

Waiver of Claims & Indemnification
Seattle Eastside Ski and Snowboard Meetup takes no responsibility for any personal injuries, deaths, property damages, financial losses or other damages or losses that may result from sharing a ride with a member.

By participating in the Seattle Eastside Ski and Snowboard Meetup, you hereby agree to waive any and all claims that you have or may have in the future against Seattle Eastside Ski and Snowboard Meetup, Meetup HQ, the Local Organizer in Denver and all Assistant Organizers, and to release them from any and all liability for loss, damage, expense or injury including death that you, your next of kin or a third party may suffer as a result of your participation in a Seattle Eastside Ski and Snowboard Meetup or transportation to and from a meetup location.

You hereby also agree to indemnify and hold harmless Seattle Eastside Ski and Snowboard Meetup, Meetup HQ, the Local Organizer in Denver and all Assistant Organizers from any and all liability for personal injury, death, property damages and any other loss, and resulting claims or actions, arising from your participation in or involvement in the meetup. In consideration of the benefit I receive as a participant in this Seattle Eastside Ski and SnowSnowboard Meetup, I hereby assume full responsibility for all risk of injury or loss, including death, which may result from my participation in this Program, I agree to hold harmless, release, waive, forever discharge, and covenant not to bring suit or claim against the Seattle Eastside Ski and Snowboard Meetup, Meetup HQ, the Local Organizer in Denver and all Assistant Organizers (hereafter collectively "releases") from any and all claims and demands which the undersigned may have against the releases by reason of an accident, illness, injury, or death, or damage to or loss or destruction of any property arising or resulting from my participation in the Program whether or not such loss, injury, or death is alleged to be caused in whole or in part by the negligent acts or omissions of the releases. The terms of this release are binding my heirs, executors, administrators, and all of my family members as well as myself. I have read the foregoing release and fully understand the terms contained therein and agree to this waiver freely and without inducement as a part of my membership in the meetup.

As a part of joining this meetup, I have read and understand the DESCRIPTION OF SERVICE, ASSUMPTION OF RISK, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT and have indicated so by JOINING the Seattle EastsideSki and SnowSnowboard Meetup that I have read the ASSUMPTION OF RISK, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT.
