PROGRAM: ?Written Description Requirement? after Ariad v. Eli Lilly
Program: In March, the Federal Circuit en banc decided Ariad Pharmaceuticals, Inc. v. Eli Lilly. The Court, following the Regents v. Eli Lilly line of cases, held there is a separate written description requirement in 35 USC section 112, paragraph 1 and that it applies to original claims. Madison will discuss the significance of this decision, what it indicates about the politics of the Court, and the likelihood that the Supreme Court will grant cert on this issue.

Madison Jellins, an IP partner in Alston & Bird?s Silicon Valley office, focuses on patent litigation and strategic counseling for pharmaceutical and life sciences clients and appellate matters before the Federal Circuit. She has extensive experience in Hatch-Waxman-related issues, including the FDA approval process for NDAs, ANDAs and 505(b)(2) applications, ANDA litigation strategy and the developing area of biosimilars. She frequently speaks and publishes on Hatch-Waxman related issues. She also specializes in appellate matters before the Federal Circuit, and has successfully represented clients in appeals, including recently overturning an $86 million dollar judgment and a permanent injunction in a patent case with a parallel reexamination proceeding.
