Thanks to Johan Appelgren on G+, seems the magic ingredient is android.permission.SYSTEM_ALERT_WINDOW.

You can tell how closely I look at that permissions dialog at install time.... :)

Um, that's an extraordinary app and to my mind it exposes a giant OS security hole. It wouldn't be very hard to, say, adapt it to catch passwords etc by putting EditText overlays in the right places.

As for the APIs, honestly no idea.
