Fellow animal advocates,
Please read below concerning a California bill which could severely thwart free speech of animal activists and limit undercover cruelty investigations in the future. A similar federal bill called the Animal Enterprise Terrorism Act was already passed into law last year. Please call your representative by this Thursday, April 17th (the hearing has been postponed til then instead of the 15th as originally planned.) On Tuesday, April 15th, the California Assembly Judiciary Committee will hold a hearing on AB 2296, an industry-driven bill that seeks to prohibit advocacy groups and journalists from conducting investigations on criminal conduct regarding animals, reviewing documents, and sharing information with state and local law enforcement.

If AB 2296 passes, it could seriously limit animal advocates' ability to expose research facilities that violate Animal Welfare Act reporting requirements intended to minimize pain and distress for animals. IDA believes that AB 2296 is also unconstitutional, as it would infringe on law-abiding citizens' freedom of speech, freedom of expression, and access to important public information.

1) Please call your state Representative today to let them know that you strongly oppose AB 2296. Get the name and phone number for your California House member. Here is a sample message that you can convey:

"Hi my name is ____________. I am a constituent and a voter, and I strongly oppose AB 2296. I believe it infringes on our freedom of speech, freedom of public access to records concerning the treatment of animals in research, and freedom of expression. Please vote against AB 2296."

2) If you can, please attend the hearing on AB 2296 tomorrow and speak out against this bill:

Breaking News. Word is this horrific anti-animal bill has been postponed for consideration in the California Assembly until Thursday. This give us more time to fax letters and call to stop AB 2296.. the Animal Enterprise Terrorism Act for California. Please CALL THE ASSEMBLY MEMBERS (all phone numbers and fax numbers are listed below) or fax a simple letter explaining your opposition to this vague and extreme measure, promoted by industry, that will chill investigation into animal abuse on California's factory farms, labs and anywhere animals are being kept. A federal act has already been passed so it's unnecessary and duplicative.

The bill limits the access to public records relating to animal research activities:
Existing law, subject to exceptions, generally provides the disclosure
of public records, as specified.
This bill would exempt from disclosure, information relating to animal
research activities when there is a reasonable basis to conclude that
public disclosure of the records would result in harassment of
individuals involved with the research
It seems that the perps of the attack, got his info by accessing public records of meeting. It also prohibits the internet posting of information with the intent to direct third parties to violence. ���

The definition of "animal enterprise" is very very broad, including pet stores and breeders:
(1) ���Animal enterprise��� means any of the following:
(A) A commercial or academic enterprise that uses or sells
animals or animal products for profit, food or fiber production,
agriculture, education, research, or testing.
(B) A zoo, aquarium, animal shelter, pet store, breeder, furrier,
circus, or rodeo, or other lawful competitive animal event.
(C) Any fair or similar event intended to advance agricultural
arts and sciences

It goes on to make it a misdemeanor do these things:
This bill would provide that every person who commits any of certain
acts for the purpose of injuring, intimidating, or interfering with the
operations of an animal enterprise, as defined, or with a person
connected, as specified, to an animal enterprise, or who damages or
destroys property because of its connection to an animal enterprise, as
specified, is guilty of a misdemeanor.

Of concern for us is the definitions of intimidating, and interfering:
(3) ���Interfere with��� means to restrict a person���s freedom of
(4) ���Intimidate��� means to place a person in reasonable
apprehension of bodily harm to herself or himself or to another

It looks like the author knew he was on shaky ground with the free speech issue:
606.3. Sections 606, 606.1, and 606.2 shall not be construed
to do any of the following:
(a) To impair any constitutionally protected activity, or any
activity protected by the laws of this state or of the United States
