Yesterday, a class action lawsuit was filed in the Illinois district appellate court on behalf of American Atheists, Freedom From Religion Foundation and several other secular groups. The suit is directed at local and national utility companies – specifically Exelon Corporation, Bodine Electric Company, et al.
The body of the document claims that the local and national companies listed are in violation of the first Amendment to the US Constitution by the “deliberate and unwarranted construction design” of their utility poles. The suit alleges that these companies conspired together nationwide to knowingly violate the “establishment clause” by joining with local Governments to erect utility poles carrying electric power lines, that are without exception, formed in the shape of a religious symbol. The symbol specified is the Christian cross. The secular groups contend that there are many more efficient designs that would be more economical to carry power lines across country, and that, by utilizing the Christian cross standard, these companies, in conjunction with local Governments, are forcing their religious symbol upon all motorists and pedestrians etc. who use most of the highway network to which these poles are attached.
It is stated that many members of the secular groups have complained about driving for miles and being confronted with nothing but cross after cross.
The case is expected to come to trial in the Fall. We’ll keep you posted.
