It is just my opinion, but I do not see a-theism as being itself a religion, or quite frankly even a philosophy. a-theism is simply a disbelief in God or gods, a rejection of doctrines offered without evidence.  A-theism can LEAD to many things, and there is great variance of ideas among a-theists, but a-leprechaunism, a-Santaism, a-unicornism, a-NoachianFloodism and so on are not religions; they are expressions of disbelief in specific ideas or event or creatures. 
 
Nor do I think that atheism needs to be protected under the establishment cause. That clause protects worshippers and non-worshippers from government mandate.   
 
And again, can't be a religion without funny hats! lol

To call atheism or stalinism or any ism that does not include a supernatural component a religion is (imo) to stretch the definition of religion a tad too far!  I personally do not consider atheism to be a religion. I do resist efforts to invent atheist churches etc.
 
Besides, good rule of thumb: no funny hats, it's not a religion! lol
