Even if you tell them it's for educational use or group study they won't buy it "but" by obtaining a permit for educational use only that proves by all means you are not violating the agreement not to sell your photos or for of any commercial use of any kind.

You need approval to shoot at Santana Row, it is private property with a right to pass. If you are just using a standard point and shoot, they won't bother you. All it takes is pre-planning and talking with management. They shouldn't say no if it doesn't deal with anything commercial.
