I think this is a tricky question - but I feel that if it's made as a 'menu', it should NEVER require a click; totally counterintuitive. 

However, if it represents a layover table of contents AND has a visual piece to indicate that you need to click, I prefer a click. These are two very different use cases. For an example of the latter, see the guide index link on
