He explains equitable distribution and how it works, marital v. separate property (what is in the pot to be equitably distributed), spousal support and application of statutory formulae for each. Finally, he explains the various processes available for resolving family law disputes: mediation, collaborative law, negotiated separation agreement, and contested litigation.
The Financial Perspective: Certified Divorce Financial Analyst Ivy Menchel (Family Wealth Planning Partners – www.familywealthpp.com) helps you understand what information needs to be gathered in order to crunch the numbers, how to make sure you are comparing apples to apples, how to determine a formula for a fair distribution of assets bearing in mind taxation and other considerations, and the importance of running scenarios to ensure that, to the extent possible, both parties’ standard of living remains at or near their pre-separation lifestyles.
The Emotional Component: Divorce coach Jean Grossman (KM Life Coaching – www.karenmcmahon.com) explains how to deal with this aspect of the divorce process, and empower both parties to move forward and participate in the process in a manner that is conducive to their own and their family’s best interests. A key factor often unaddressed in a traditional courtroom model is the extent to which the social upheaval and emotional feelings that the parties are experiencing during the separation and divorce process can severely impair their ability to participate in a constructive way to the resolution of the financial (and other) issues at hand.
