So the question is how does the public lay claim to the pipes under imminent domain and make a regulated utility out of the cable companies?

Let's see... Last year I watched the entire season of 24 from the web for free.  Downloaded my first iTunes movie rental last week.  CNN has lots of video content.  I'd say I'm off cable TV in a couple of years.  Landline has been gone for 2 years.

It's already over for the phone and cable companies.  Big drop off in business within 5 years.  In 10 years, it will all be over the Internet.

I hear you, bro. Archimedes is supposed to have said "Give me a lever long enough and a fulcrum on which to place it, and I shall move the world." I say, "Give me a fast-enough PC and a fast-enough broadband Internet connection, and no bandwidth caps, and I'll never have to own a TV tuner, and FM radio, or a TV ever again." Not as snappy a saying but, hey, I ain't Archimedes :)
