As I understand the rules, merchants are not required to collect taxes in states where they don't maintain a presence. This may change (see a different thread that had Jeff Bezos' name in the title), but at the moment it should still be how it works.

look for good extensions if you are using magento to tackle that.
- Logistics - check that the rates are correct with the items being shipped, otherwise there might be need for customization of the extension.
