For PPA, there's also a possibility to add something new, then continue to file another PPA (with improvements this time) , but the filing date will also be the later one.

but yes, the attorney's search may or may not be thorough as you could do it yourself.

If i remember correctly, you can write/file provisionals yourself. You can also do the search yourself on the uspto site.
If you buy a search from an attorney, make sure they do an in depth search so that its more thorough than something you couldve done yourself. Some attorneys have different search tiers at different prices. Its a great idea to file provisional first so that your product has the protection needed to test the waters in its market, whether youre looking to license, partner up or manufacture/sell your product yourself. If you see that alterations need be done to the patent after a year you may make alterations those alteration when filing for a utilities patent. Remember, filing a Provisional patent application (PPA) will protect your product for a year at which point youll have to either abandon it or file your utilities patent. Best of luck!

Hi all,

I am planning to patent an idea. My attorney is asking for 1300 dollars to do the search to find out if something similar exist and to see if it makes sense to apply for patent. If there is nothing similar that exist, he would file for provisional patent (charging 1200 dollars excluding the registration fees) as I do not want to spend a lot of money on utility patent (for which he is asking about 5000 dollars).

I wanted to take an opinion on:

1. Does it make sense to do the search before filing for patent and spending 1300 for that search before filing for patent?
2. How much do lawyers charge for that search and also for both provisional and utility patent?
3. Is it a good idea to file for provisional patent over utility patent?

I will appreciate your help!!!

Thanks

Jatinder
