He's 'facing' jail time. The only way he goes to jail is if he continues to scoff at the courts the way he has been.

I wouldn't say that a rapist would get more time. There have been cases in which rapists get less than 6 months of jail time.

You can google up a case in which a man gets 6 months in jail and 10 years probation for raping a child under 17 years old.

Not only was the person raped, but it was a case against a child. These court systems are screwed up.

if we're lucky he's get one night in a real jail, so he can learn how it feels to have his security breached.

Ross, I agree that he is being quite *foolish* (as one member said: feeding his ego) -- however, he does *not* deserve more jail time than a rapist (if that is true and I read that correctly). He caused no financial or personal harm. He exposed email addresses, not financial records. If that is a security issue, then by lord do we have a massive problem on the web because this has been going on for the 14 years I’ve been around nerds. ;p

By the way – I have exposed 3 vulnerabilities in my career. 2 to two major ecommerce sites. Surely glad these “cowboy” legal people weren’t around then.

The ruling does violate the 8th Amendment- its worth appealing.

How many years in jail do people who scrape email addresses from a mailing list, and then subsequently spam those same addresses, get?

The larger problem is that far too many of our lawyers and our judges don't know enough about technology, yet they sit in judgment on cases involving the use and/or misuse of that technology. Something has to be done...
