What a strange situation. I don't remember anyone mentioning financing a test case. We did bring up that if Mark LaRusso wins for mayor he will have their ordinance brought up for reconsideration. Agree we should wait till after next Tuesday to consider further action.

They did it again!
This time when my delinquent truck had a red light ticket sent to me, after a few screw ups by Needelman's office, I filed a "Petition for Declaratory Relief" pursuant Chapter 86 Fla. Stat. I wanted to get a straight up ruling in county court on the (un)constitutionality of the Red Light Camera Law (the "Mark Wendal Traffic Safety Act) and Palm Bay's "Dangerous Intersections Safety Act".
Well, I was waiting for a Notice of Hearing, but instead, today I received an Order in the mail Dismissing the ticket because of "lack of evidence" presented at the (un-noticed to me) hearing on this case yesterday (October 30, 2012).
I have several choices in proceeding. I can let it go,I can fight back and demand a ruling on the constitutionality of this law, or I can wait a while and re-file (this would be the most expensive route). As I am currently a poor student, I can not afford court reporters and transcripts. At the last RLCCEF meeting, it was mentioned that someone was going to finance the filing of a "test case" against Melbourne. Melbourne and Palm Bay are using the same vendor (Gatso USA) so that party is the same. I am willing to continue this fight! Anybody wanting to discuss this, I can meet and present my case. I would like to wait until after the elections to discuss though. Let me know your thoughts. Thanks, Scott Cuthbert.
