Re: [linux-5] Refunding Windows 7 Starter tax/charge in Singapore

I hate to hijack my own thread, but yesterday when i tried to post this same topic on lugs mailing list, nothing happened. No emails were sent out. Now I can see "http://www.lugs.org.sg/" is down as well. So the mailing lists [address removed], [address removed] and "http://www.lugs.org.sg/" are no longer maintained? I couldn't see any email from there for a long time. Last posting was from 15th Nov 2011. And last email from moderator was Feb 1st 2012.

And Sanjeev,  I hope lack of further responses from you, is not because I replied to "Sanjay" instead of "Sanjeev" I am sorry about that, I hope you already know the reason for yesterdays "mishaps" :) If you are the same person I think you are, whom I met on LUGS AGM 2009(August), I know you will forgive me for that mistake :)

Hello Sanjay,

Still inebriated, but some more information

It is supposed to be in Windows 7 EULA  EULA that states that you're entitled to a refund from the manufacturer if you decline

Does that make enough Legal argument? I don know...

And here is another email, supposed to be from Acer Australia
http://blog.wpkg.org/2011/06/12/acer-accepting-windows-tax-refund/

And yeah copy paste of my old reply to you on your comment
Not since 2003, to my knowledge.  I would be happy to be proven wrong, and will pay S$50 to the first person who can point me toa PACER decision.

Please read these for Acer notbooks
This one is from 2009. Should I believe it?

And this thread is from 2011 all the way to Feb 2012.

Yeah my use of the word ẗax"mainly attributed to these threads as I did a search when I was in Suntec,  on my phone and found these rather believable threads.

Hello all,

I just bought an Acer Aspire One D270 from IT show 2012 Singapore. As usual, it came with Windows 7 Starter Edition. Now I have heard that in US and UK people actually managed to refund some amount towards their unused Windows copies.

I am gonna run Fedora LXDE on my new netbook; just like on this Dell D610 I am using now to write this email.

Congrats!

Now the question is,  such thing even possible here in Pro Microsoft Singapore?

What has "Pro-Microsoft" got to do with it?

I made sure they didnt start the windows on my computer or install any utilities as I forbid them from opening the sealed package before handing over to me, So when I booted, it started with Language Selection for windows 7 starter installer, which I promptly interrupted by turning the computer back off. I haven't accepted any EULA as I havent  gone any far on the Windows 7 Starter installer. I am prepared to ¨Reject"instead of Accept, when eventually the EULA comes up.

So far so good.

So any heads up on how to go about this will be really great.

I can assist you in fighting this, including contributing to legal fees.  One pre-condition, so that I know how much the refund will be, exactly how much does the Invoice list as "tax" or "charge".  Since we are going to fight this out legally, it would be helpful to be exact.

(On a totally different note: I bought a Sensation XE today.  I was told that it came with a Beats earphone, worth over S$200.  Despite me telling Starhub: a) I am tone deaf and b) Please take it back and reduce the price by S$50, they refused outright.  True story.  I have not even opened the earphone packing, and will be happy to return it to Dr Dre for a refund.)

Ronnie, you can only get a refund of what you paid for.  Since you did not pay for the Windows Licence, there is nothing you can claim back.  Acer paid for the licence, and it could probably ask MS for money back if you do not use it, but that is their decision, not yours or mine.

Thanks
Ronnie

Once again, this may be unfair, but if anyone can show me a legal argument which we can stand on, I will chip in with him/her to support Ronnie.  If this is a case of
