The Photographer is under no obligation, nor should he be, to produce a
model release.  It's the model's responsibility to show advocacy for the
model.  Pictures that a Photographer takes, belong to him, until he/she
release or license use or ownership to another party.  If a model choses not
to engage into an arrangement with the photographer, that is the model's
failure to protect his/her own interests.

At least that's what I've read and have been told repeatedly.

My advice to all models. Don't shoot without a model release THAT YOU HAVE
READ PRIOR TO THE SHOOT. If you don't read it then you deserves what you
get! The point is, due your homework and see and read the release prior to
the shoot or suffer the consequences. I have seen so many photographers do
"test" shoots and then sell the images to content buyers.

I have a question for the photographers in this group. Do you ever have
model release forms for models or other people  to sign whenever you have
photo shoots with them? You know? A legal document signed by the person in
the photo allowing his or her photograph to be published in one form or
another by the photographer. Anyway, I was talking on the phone with a
Marrieta photographer two days ago and he wanted to do a 60's & 70's style
shoot with me after doing those test shoots last month. I told him about
providing model release forms. He says he doesn't believe in providing any,
even though it is usually the photographer or artist's job to do so,
especially when they are amateur or professional. Whatever it is, he could
be posting models' photos anywhere illegally without their permission, even
though he claims to be professional when in reality, he's not. He just takes
pictures of girls and women for his own use. Anyway, here's a link to his

I have a feeling he's been posting his models' photos on there without their
permission, especially the Russian models he's worked with. And, no, they
are not test photos. They are actual photos from his actual shoots, not test
shoots, in my own terms. It's a good thing that I canceled that retro shoot
with him and that I don't want to work with him anymore because he can post
my photos anywhere without my permission.

Of course, I would advise any model on here with or without experience to
avoid working with this photographer because he will use your photos without
your consent.
