True, but the real issue comes after you pay BMI whatever they require, when you're practicing, or teaching a song that is represented by an artist who is signed with ASCAP. Once ASCAP learns that you've paid BMI, I'm sure they'll come calling.

By the way, if I remember correctly, the Charlotte location that they threatened was 'ordered' to pay $6000 - for four songs. I'm assuming that this included 'damages', as the annual license that they charge (based on ASCAPs rates) is probably a tenth of that. I base that on my former DJ duties, and getting quotes from ASCAP, to make sure I was legal.

I concur. But BMI practices still seem to be shady.  Demanding payment for original work performed by the artist who is not a member of BMI or ASCAP.  Perhaps a little push back may help keep them in line and honest about the charges.  Bowing down on their demand id dangerous if this is how they behave.  My 2 cents.

Hi Scott, Wayne, etc.,

Do you guys know how much money we are talking about ?  Asking because 1) it seems BMI / ASCAP will find us all eventually, and 2) we could take a collection among our regular attendees to help our venues pay these fees, if they are not unreasonable.  Let's face it, we do play copyrighted songs, and some people may listen to us out of boredom :-)    Helping our venues pay beats losing our venues with very little notice.

become the norm for BMI the last couple of years.They
threaten legal action if they aren't paid, regardless of
the legality, or even reality, of what they are stating. A
simple google search will show how many of these form
letters they send to restaurants, bars, etc., after taking a
page from the RIAA's book. Many restaurants pay, only to
then be threatened by ASCAP. Normally, they will ignore your
attempts to contact them to discuss the matter, unless your
contact is in the form of payment. They don't want to
talk. They want you to pay, or go to court, so that they can
cause undue suffering on the part of the business, in
effect, forcing them to pay one way or the other. Very
disappointing. A restaurant in Charlotte was threatened much
the same way, over FOUR songs that were written by the
people performing them - and thus BMI had no legal cause to
sue, but threatened to anyway.

fyi right
now I am looking at other venue options for the North
Raleigh Learn & Share meet-up.  As of last night BMI
was not being cooperative.  I have cancelled the meet-up
for Wednesday 11/25, which we were planning to do anyways
due to Thanksgiving.  Stay tuned for more developments.

Jim Paul who is contacting them to get it straightened out
(explaining to them that we aren't entertainment).  For
now the meet-up is still on but the situation is still
