Hey Beto, sorry for the stressed out summer. I think you can get out of this one. PM me if you want to chat about.

I have to appear in court September 11th at a State court all because I was flying a toy at Ocean Beach. Flying my DJI Phantom 2 like many of us have since last year they decided to crack down on us instead of warnings they give citations to appear in court. It happened on June 08 and then they announced a ban from Ocean Beach San Francisco on June 23rd. The National parks officer even took my memory card for evidence with out a warrant. There are no signs on the beach that say national park or that you cannot fly a model aircraft. My citation says for flying a model aircraft. The letter I got from the courts says paying the $25 processing fee I'm admitting I committed a crime and will be in public records as a criminal.

Also might have to turn in my copter even though I had sold it I don't know what they can say. This is very harsh when I had first asked why can't you just give me a warning now that I know about your new rule. He said take it up with the judge. This has been the most stressful summer for me ever. They have know idea what this has done to me and how worse things will get for me if things go bad in court all for flying a toy at the beach.

No so good of an idea as it will just put fuel to the FAA fire.
As you can see in the blow link some guys from down under have done it as well.

watch the end of the video.... and you know why.

I forgot to ask during the meeting who and who is not an AMA member? I bet only 20% are that should be 100% as the AMA is the only real US body can fight for us against the FAA. So we have 980 droners on here I bet about less then 100 are AMA members. Yes I am a AMA member, so please prove me wrong 99 to go

    thanks

While I am an AMA member since I started flying, it wasn't all that long ago that the AMA was firmly against both multirotors and FPV.

I did see someone recording but have not seen a video. Bryan sent out the slides but just in case, here they are. https://drive.google.com/file/d/0B4rwbbP5HMlXcFpjeFotSnR1dXc/edit?usp=sharing

Was this ever recorded or is some sort of deck from the presentation available? Seems like it was a great event.

I got a citation for flying my quadcopter at ocean beach. No warning but a citation to appear in court. New rule no signs on the beach of the ban of our devices and they still took my memory card and cited me to appear in court. Not fair to treat us like criminals with out information announcements. Now they announce it many weeks later.

Beto - contact the EFF, I know they have many lawyers and drones may fall into their domain since it is a embedded system.

So confused... From everything I have read, it is illegal to fly in any National Park (i.e. Presidio, GGP, etc.), but I thought Ocean Beach was ok. Is Ocean Beach also part of GGNR?

Thanks for the meetup! Really great presentation.

Self-plug: we've got a drone flying event on Aug 17th in Oakland.

http://mobile.susbexpo.com/#2830 you can find Jim Williams, than look for the videos that Patrick Egan, the organizer has uploaded, maybe you need to look for under "drone tv". I'll be happy to connect with you at the event, we can chat.

Is anyone from the FAA, or our local government going to be at the event. Hopefully we can record the discussion and presentations. I am sure that there are a lot of curious people. Maybe someone can bring a few Go-Pro's and a mic? Maybe we could even show it live. I can edit the video and audio later if necessary.

As I understand based on the cases I have read, may be FAA allows to sell UAS but they do not allow to sell the product obtained (like videos or photo) by using UAS, correct?

      July 20, 2014

    • Bryan G.

To date in general the FAA has targeted preventing commercial use, and specifically commercial services. If you look back at manned flight an individual or a company can buy a small aircraft (a Cessna 172). With a private pilots license you can fly the Cessna, and others can ride with you. However if you charge people to ride with you it is then a commercial operation, and you need to fulfill the extra requirements of having a commercial pilots license, as well as the entity you work for must fulfill a number of additional requirements (insurance for example).
This is my interpretation of why they are targeting the operations that they are. They are coming from the commercial pilots license type model.

Drone is used to mean something that shoots missiles all the time... by laymen and the media and by a good number of people in our hobby as well. Sure, it's being used incorrectly and is lumping a large group of very different vehicles and toys into one category that really have very little in common. We should try our best to stop using the term "drones" to refer to RC multirotors or RC planes and we should do our best to educate the public on the differences between our toys/models and military or surveillance grade vehicles.

I have been saying this for more than a year. D**** is a four letter word in our society, so let's call them what they are. Whether that is SUAS, radio controlled model/hobby aircraft with an autopilot board, whatever.

A pretty good critique in Forbes of the FAA's rather absurd rules (or lack thereof)...

So where can one fly a quad in SF?

    June 24, 2014

    • Davi

something like "even though i have taken every precaution and am a skilled operator concerned with the welfare of those around i was unaware of this ban. now that i have read the citation reference and considered it thoroughly i see room for safe operation. for your consideration i offer reasons 1,2,3 within the rule that should allow modern drones."

      June 30, 2014

    • Steve S.

I think getting away from calling them drones would be a huge step. What I fly is a remote controlled quadcopter.

For anyone looking for a place to fly there is a Meetup in Oakland July 13th. Free Pizza and beer and both warehouse and outdoor flying space.

$25 processing fee for when I appear to court and who knows what the judge might charge me. I'm going to fight it and I even have the media to back me up. They just said for me to let them know when I'm ready.

Bento - See the attached. http://www.firerescue1.com/fire-products/technology/articles/1932158-Feds-move-to-ban-drones-in-400-national-parks/

Based on the AP article, it sounds like the ban is more like a work in progress. Officers may not generally confiscate or demand to see your photographs or video without a warrant. There is no legal right to take your photo memory card. Police may not delete your photographs or video under any circumstances. It may be worthwhile to contact the ACLU.

    2 · June 24, 2014

    • Beto "Mooncricket" L.

I contacted the ACLU and they said the drone stuff they know nothing about since it is an FAA situation out of their hands until I go to court they told me but she still seemed clueless on how to answer about what happened to me.

      June 26, 2014
