Suffolk resident's bid to challenge term-limit ruling blocked on appeal

The Appellate Divison in Brooklyn last week denied an effort by a backer of Suffolk’s term limit law to appeal a lower court decision that threw out the restriction for District Attorney Thomas Spota and two other countywide elected officials.
The appellate court, in a one line ruling, rejected Peter Nichols' effort to intervene in the case where state Supreme Court Justice Ralph Gazzillo threw out term limits for Spota, County Cerk Judith Pascale and Sheriff Vincent DeMarco. 

Gazillo’s rulling also barred Nichols from intervening in the lawsuit other than filing papers as a friend of the court, which gave him no standing to appeal the decision.
Bruce Plesser, Nichols’ attorney declined comment. 

Spota already has backing of both Republican and Democratic leaders for another term, but so far has declined comment on whether he will be a candidate for re-election.
