I would agree with Karen, Joe, and Jean.

We do this on a fairly regular basis.  We have made one change, though.  With our first employee, we agreed upfront to do this.  We did incur legal costs of ~10k.   Unfortunately, the employee didn't work out and we ended up having to fire them.

What we do now is first determine how much time they have left.  If it's less than a year then we don't move forward.  However, if they have more time left, I tell them during the interview process that we are open to sponsoring them, but this is dependent on their performance.  If they work out we start the process at their one year anniversary.

I’ve hired folks like that before. Definitely the *company* pays all the fees. No cost-shifting to the employee. There are attorneys who specialize in that, and they should be the ones handling that paperwork.

Steve,
I'm not sure about Green Cards, but companies are legally required to pay any filing fees associated with an employee / potential employee applying for a work visas (e.g., H1B). There are additional requirements for visas like minimum salary (H1B is in the 50-55K range, last I checked), preferential treatment for certain types of jobs and degrees (candidates with STEM jobs and degrees are more likely to get approved ), etc. You should definitely speak with an immigration attorney before moving forward.

I have an employee who's interested in the company sponsoring him for a Green Card. I understand the legal costs and filing fees can be in excess of $10,000. I'm curious whether this is usually paid by the company, the employee, or shared between them. And perhaps it's different for large vs small companies. If anyone has experience with this, it would be great to hear about it.
