General Release of Liability

General Release of Liability

So this is the least fun part of Get Out. But please read it. We would like to take this opportunity to remind everyone that Get Out Philadelphia takes no responsibility for the misdirected wanderings of its, um, "leaders." If you sue us there will be nothing to be gained except a beat up Hyundai, 50 feet of nylon rope and a couple of smushed Clif bars. Thank you for your participation (and sense of adventure).

When you joined Meetup.com, you agreed to Meetup's Terms of Service. This section in the TOS acknowledges your release of Meetup and Get Out Philadelphia from any damages incurred while participating in our events.

Section 5.2 Release. Because we do not supervise or control the Meetup Gatherings or interactions among between members and other persons or companies, and because we are not involved in any way with physical transportation to or from these Meetup Gatherings or with the actions of any individuals at these Meetup Gatherings, and because we do not control Paypal, credit card companies or other payment processing companies, and because we cannot guarantee the true identity, age, nationality of Platform users, and because we have very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of the Platform you agree that you bear all risk and you agree to release us (and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and Meetup Group Organizers and their designees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of the Platform, your Third Party Transactions, our resolution of any disputes among users, and/or your transportation to or from, attendance at, or the actions of you or other persons at, a Meetup Gathering. You further waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a release or waiver. You waive and relinquish all rights and benefits which you have or may have under Section 1542 of the Civil Code of the State of California or any similar provision of the statutory or non-statutory law of any other jurisdiction (including without limitation the states of Missouri, Delaware and Pennsylvania) to the full extent that you may lawfully waive all such rights and benefits.

Get Out Philadelphia is a non-professional organization. We are only providing the means for you to adventure, and do not in any way claim to be professionals or otherwise licensed, certified, trained, etc. Participation in our activities is always your own choice, at your own risk. You and your guests' participation in our events acknowledges your awareness of the risks, which Get Out Philadelphia will make you aware of, to the fullest extent of their knowledge. All participants agree to forever release, hold harmless and indemnify the organizers and assistant organizers of Get Out Philadelphia, as well as their families, from any injury, damages or death resulting from participation in our activities. All non-member participants and guests of members are included in this indemnity.

We are just a group of friends who like to go do stuff, and we're glad to invite you along. The group was not founded to become a full-service adventure guide program; most of the organizers are trying things for the first time too, and they do not earn any money from all their hard work in managing events and questions. Please do not expect them to know all the answers or be able to solve every situation, provide food, water or equipment for your personal use, or give you perfect directions from your front door.

At the same time, we're more than willing to help if you don't know how to start! Just ask. We'll share everything we know; just remember we don't know everything. Bring your sense of adventure and join right in!
