Hi, AdnanI have experience setting up a nonprofit. You actually can register with the NYS Division of Corporation as a nonprofit. But if you want to be recognized as a 501 (c)(3) or any other specific type of nonprofit, you would have to submit an application with the IRS. It takes within a year for them to process your application, pay the filing fee and then they will issue you a Determination Letter, recoginizing you as an approved nonprofit for Federal taxation purposes. There are also, State requirements to be recognized as a nonprofit for State tax benefits. Most nonprofits opt for the Determination Letter in order to get funding from outside sources ie. grants, etc. For more information, please go to http://www.irs.gov/Charities-&-Non-Profits/Applying-for-Exemption---Difference-Between-Nonprofit-and-Tax-Exempt-StatusHope this helps.
