In the Spring of 2018, near the Close of Business on the Friday of the St. Patrick’s Day (holiday) weekend, Wake Stone, via email, asked NC DEQ to change one word in their Triangle Quarry mining permit. Wake Stone claimed this was a typographical error. On the following Monday morning, essentially 60 hours later, without any research, DEQ complied with Wake Stone's unsubstantiated request.

DEQ changed the word "sooner" to the word "later." This change resulted in the life of the Triangle Quarry mine operation going from a defined maximum timeline of 50 years to an indefinite life. This is in no way a minor change; it is a very substantial change and is the antithesis of the bases for issuance of the original permit which was protecting Umstead State Park (and preventing any future quarries adjacent to the Park).

Wake Stone needs their Triangle Quarry operation to continue in order to create their new mine pit on the Odd Fellows tract, land that has been on the Umstead State Park acquisition list since the Park’s inception in the 1930’s.

Umstead Coalition filed a lawsuit against NC DEQ to get the Triangle Quarry mining permit changed back to the original language. At one of the recent hearings, the judge’s ruling is favorable to protecting Umstead State Park and restoring the Sunset Clause. Subsequent to this recent hearing and after years of litigation between just Umstead Coalition and NC DEQ, Wake Stone now has filed to intervene (i.e., enter into this ongoing lawsuit as a 3rd party) for the purpose of having Umstead Coalition’s Sunset Clause case dismissed, that is to void our win.

The virtual hearing on Monday, 1/Dec/2025 is for a judge to hear Wake Stone’s motion to intervene in the Sunset Clause case and to have the entire case dismissed.
