Replacing the software with an open source version would create huge liability problems. I doubt that people would be willing to jailbreak their cars when a bug may make brakes fail, or "brick" a car worth tens of thousands.

The aftermarket print cartridges companies fought back and had the practice changed. I would expect that the aftermarket automotive parts companies would/will do the same. They're not going to sit back and let GM dictate the replacement parts market. Plus, if consumers are aware of this (and I often wonder how many would be), they would start buying cars from other companies and stay away from GM.
