audrey,
I simply meant by "deserves to know" legally informed. My releases are designed to protect me.

It?s not as serious or complex as some are making it.   A model is responsible for his/her own knowledge of the law.  I am a photographer, not a legal advisor.  I don?t have to inform or educate the model on what their rights are or should be.  The same level of intelligence should apply to photographers as well.  That doesn?t mean either party should be misleading, dishonest or deceitful either.

I never once heard anyone assert or claim that a model should ?be nice? to the photographer and inform the shooter what his/her rights are.  We are all adults and professionals.  If a model doesn?t have enough common sense to require or inquire about a release, then frankly, that?s the equivalent of a photographer accepting work without any knowledge of what the work requires; you are setting yourself up for failure and disappointment.

A model release is like a condom. It protects it?s user. Don?t use one at your own risk. Frankly, I think the model deserves to know what you can and can?t do and what she can and can?t do with the images. And then of course are the agency releases?.

For me it depends on what I am going to do with the photo, because I am a MFA student I do not always require a model release If I feel that I will be using the photos in the future to print then I will get a model release, but in general you can sell a fine art print with no model releases but you can not mass produce that image but I don?t remember what the number is that you can sell, I do want to let you know though if you were to take the photographer to court you would have to show that the photo damaged you the court really does work for the arts unbelievable hope this helps
