As agreed, I made an effort to answer the question:
what legislative body decides whether a particular area is fluoridated?
The closest thing I could get for answer is 'city councils or by 
referendum'.

It should be noted that in 2012 an assembly panel passed a bill that was 
proposed in State Senate in January 2014.
