Switzerland’s New Blockchain Law - Introduction by Luzius Meisser

On September 25, 2020 Swiss Parliament unanimously passed a number of legal adjustments (Geschäft 19.074), which will likely be set into force in 2021. Luzius provides a summary of these adjustments, their background, and what they enable for Switzerland.

Essentially, these adjustments serve three purposes:

  1. Creating explicit legal foundations for the issuance of security tokens.

  2. Preserving the property rights of crypto holders even when the coins are held through a custodian, essentially saying: “Not your keys, still your Bitcoins.” ;-)

  3. Making it possible to run a security token exchange under Swiss law.

By passing these changes, Switzerland is years ahead of the European Union, which recently announced similar plans. The Swiss approach also seems more balanced and elaborate than Liechtenstein’s blockchain law.

Luzius is one of the experts consulted by the Federal Council and mentioned by name in the official message accompanying the proposal. He holds master’s degrees in Computer Science and Economics. Before co-founding Bitcoin Association Switzerland, he served as CTO of cloud storage startup Wuala. He is an investor in selected startups and serves as board member of Bitcoin Suisse. His latest venture is Aktionariat, which plans to make use of the new law to enable the blockchain-based trading of Swiss securities.
