I believe many state institutions, like schools, only look at the year you turn a certain age. It's possible that a state prosecuting attorney may use the same system to determine legal age in such a crime.

Many law firms offer a free consultation. I suggest you call one here in Austin that has expertise in defending young offenders. They would know every detail.

17 is legally an adult in Texas, as far as criminal prosecution goes. 16 and below is a juvenile. A 17 year old, or someone who commits a crime at 17, can't be sentences to death but is otherwise eligible for normal punishments. A juvenile becomes an adult on his 17th birthday, actual time of day is immaterial. All that matters is the date.
