Investment choices with MezFi, ASIC Case Update & Loan Product from Block Earner

On 9 February 2024, the Federal Court of Australia handed down judgment in ASIC v Block Earner, which had been characterised as a “test case” concerning important issues regarding the application of financial services laws to crypto-related products and services.

The Court found that Block Earner had contravened the Corporations Act by offering a (since closed) fixed yield product without an Australian Financial Services Licence (AFSL), but dismissed the Australian Securities and Investments Commission’s (ASIC) claims in relation to a separate decentralised finance (DeFi) access product.

Adrain from OMB Lawyers and Charlie from Blockearner will give their valuable insights into the matter and, afterwards, join Jerome from Mezfi on the panel.

Block Earner recently launched Crypto-Backed Loans with an Australian Credit License authorisation. This allows Bitcoin and Ethereum holders to get AUD loans using their crypto assets as security and keep their market exposure. James and Charlie from Blockearner will share some early insights about this new breed of crypto product and its potential for the Australian market.
