Copyright Issues

Due to the fact that I have had some associations with some dubious characters in the past, I need to make the following statement:

I retain the copyright to everything I have ever written, whether it was written under my legal name or a pseudonym. No copyright of mine has been legally transferred to anyone, with the exception of some educational material transferred to a Montessori school for their distribution that was paid for in full. For everything else I have ever written, I retain the right to say that any distribution can only be made if my permission is granted in written form. I hereby withdraw any previous permission to distribute my material in any form, unless you have my permission in writing: and I want to see a copy of any supposed agreement.

Any or all of the copyright owner's exclusive rights or any subdivision of those rights may be transferred, but the transfer of exclusive rights is not valid unless that transfer is in writing and signed by the owner of the rights conveyed or such owner's duly authorized agent.

Copyright protection subsists from the time the work is created in fixed form. The copyright in the work of authorship immediately becomes the property of the author who created the work. Only the author or those deriving their rights through the author can rightfully claim copyright.

If you think you have acquired the copyright to any of my works, which I forthright deny (with the above mentioned exclusion), then please contact me.

Where in the world does this come from?

You've been a member of Meetup and NTOS in particular for more than six months. What's new?

What does this have to do with us here at NTOS? Have you had any difficulties here?

Who are you talking to?

Each of us using's services agreed to its general terms of service when we signed up. See Meetup's "Terms of Service Agreement":­ As the "Organizers" of NTOS, we can and do implement additional standards for participation in our particular group, the North Texas Objectivist Society. Regarding copyright issues, however, Meetup's standards appear sufficient.

To my knowledge, we have not seen any copyright issues here between members of NTOS. If you have a problem with someone here, please call it to the Organizers' attention. We have standards for participation in NTOS and we consider addressing new issues as they come up.

Frankly, your statement appears uncalled for here. I wish you had asked me privately about this before posting it.

FYI, Regarding copyright issues, Meetup's Terms of Service include:

3.2 Restrictions. In consideration of your use of our Platform, you agree that Your Information:(a) shall not be fraudulent; (b) shall not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (c) shall not violate any law, statute, ordinance or regulation; (d) shall not be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (e) shall not be obscene or contain, pornography, child pornography, or photographs of unclothed person(s); (f) shall not contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (g) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; (h) shall not link directly or indirectly to any materials to which you do not have a right to link to or include.

3.3 License. We do not claim ownership of Your Information. We will use Your Information only in accordance with our privacy policy. However, to enable us to use your Public Information and to ensure we do not violate any rights you may have in your Public Information, you grant Meetup a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise, commercialize and exploit the copyright, publicity, and database rights (but no other rights) you have in your Public Information, in any media now known or not currently known, with respect to your Public Information.

4.3 Interference with Platform.
You agree that you will not:
(d) copy, reproduce, alter, modify, or publicly display any information displayed on our website (except for Your Information), or create derivative works from our website (other than from Your Information), to the extent that such action(s) would constitute copyright infringement or otherwise violate the intellectual property rights of Meetup or any other third party, except with the prior written consent of Meetup or the appropriate third party.

15.2 Copyrights and Trademarks of Others. Meetup respects the intellectual property of others, and we ask our users to do the same. To the extent Meetup uses a trademark that is the property of a third party, Meetup shall provide clear notice to anyone viewing Meetup's use of that trademark that (a) Meetup does not own the trademark and that the trademark is the property of a third party, (b) Meetup has no affiliation, connection or association with that third party, and (c) that third party has not approved or sponsored Meetup's use of the trademark in any way. We may, in appropriate circumstances and in our discretion, remove, or disable access to, material that infringes on the rights of others, and terminate access to our Platform to those who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide our Copyright Agent the following information: electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; 2.a description of the copyrighted work or other intellectual property that you claim has been infringed; 3.a description of where the material that you claim is infringing is located on the site; 4.your address, telephone number, and email address; 5.a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; 6.a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

I wasn't trying to impute the character of anyone in NTOS, nor was I trying to imply that anyone in NTOS has violated my copyrights.

However, I do think that the issue of copyrights and intellectual property rights in general are a good topic of discussion, especially as they are a component of individual rights, which, as Objectivists, we do uphold. I was both bringing up the topic for discussion and making explicit my stance regarding copyrights.

Thank you for the clarification of's position regarding copyrights. By my understanding of what you posted, I retain the copyrights of what I post, as does anyone else posting regarding their copyrights to their own work.

I overreacted. Sorry.

We all retain our copyrights here, except for the license to Meetup, which is very broad -- so you probably shouldn't publish anything on Meetup that you think would be commercially valuable.

I sent an email to the support at for clarifications about copyright and ownership issues. Their understanding of the agreement to use is the same as mine: The person posting materials is the owner and retains all copyrights.

Here are snippets from their reply to me:

"We don't own anything that a member posts on the site (defined in Section 3.1 of the Terms of Service as 'Your Information"). However, by posting it on the site, you provide us with a license to use it (Section 3.3)." "So, to answer your question more specifically, you don't lose copyright. We explicitly say that we do not own your information in our terms of service here:­ "

Actually, I probably need a vaccination -- against taking things too seriously.

Speaking of a little drama, I should explain. What I overreacted to in Tom's initial post on this thread was not a discussion of copyright issues, but rather the following:

First, the statement did seem to impugn one or more of us as "dubious characters." I am sensitive to any such words because we are doing our best to try to build a group aspiring to include the highest minded and most moral individuals.

Second, the statement even impugns Tom himself, which I am sure he did not intend. It states that he has had "some associations with dubious characters in the past." People who have associated with dubious characters in the past often have (or had) dubious characters themselves, and I did not like that implication, either.

Third, it warns us against copying or somehow abusing his works. Especially here, we should not have to warn each other against such things, and this warning was uncalled for here, even if he has had difficulties elsewhere.

All of this is in the context of my personally valuing Tom's participation in our group for his years of study and I admire him for his high dedication to Objectivism. I personally like Tom and I have known him for a long time. I first me him about twenty years ago when we were in university at the same time. We have not seen each other hardly at all between then and now, having met again thanks to NTOS, but I still count him as one of my long-time friends.

Even though it would not rise to the level of any copyright infringement, I had months ago "copied" one of his lines for our About page: "Let us keep our website and message board as a beacon for those searching for others interested in Ayn Rand's works and Objectivism." I hope Tom doesn't mind this, as copying can sometimes be the sincerest of compliments.
