The process by which serial linguistic streams realize a community that has a consensus about facts in a domain needs elaboration and discussion.

The question of how to educate people to communicate (participate in such a process) is sorely lacking.

The little red school house problem: Who is right about its interpretation, the book's author, the film's director, or the reader or movie goer?

The conflation of opinions and facts. However, these are not mutually exclusive categories.

Money as speech. There seems to be some ways in which some expressions gain access to much more of the audience.

Do drug advertisers (not ad agencies) have responsibility for the ill effects of the drugs they advertise?

Free speech does not work unless both speaker and listener are included. Speakers need courage and listeners need attention and consciousness. These are attitudes that are required but they are not encouraged in our society.

So the question is who is the arbiter of truth if not the individual?

My proposal was as follows:
-	Opinions and facts are not mutually exclusive.
-	Some expressions are capable of truth-evaluation.

Whether an expression is punishable should take into consideration whether the expression's truth can be determined and if so, whether or not it's true. The expression of demonstrably true expressions should never be punishable.
