Since the local paper didn't cover the local demonstration of the 'Counter Inaugural' and now the City is acting like peaceful protests are not a citizens right, I urge all members to act on the following:

Recently, the City Manager issued a memo to the City Council regarding
the numerous complaints they had received about the false arrests of
Carly Delso-Saavedra and Janice Jordan at the January 20th
Counter-Inaugural demonstrations. The memo from the City Manager can be

The memo contains numerous inaccurate and plainly false statements and
also tries to justify the false arrests by painting a picture of the
"good protesters" versus the "bad protesters", without actually talking
about the specifics of the events at the time of the arrests. This so
called investigation even cites an incorrect location for one of the
the arrests.

Please read the letter below, and if you agree, please send it on to
the City Council, the City Manager, The Mayor and Michael Aguirre, the
City Attorney who is handling the cases.

Please stand up to protect free speech and freedom of the press in San
Diego. Innocent people should not have to fear arrest and jail time for
simply exercising their First Amendment right to protest and to make


As a resident of San Diego, I am very concerned for the state of our
city when the city manager can pass off a memo to the city council that
is filled with outright false statements and inaccuracies. In the memo
entitled, "Citizen Complaints - Presidential Anti-Inauguration
Protest", Lamont Ewell, the city manager, made numerous false and
incorrect statements.

First off, the letter says that "India Media San Diego" is a "protest
group". This indicates the shoddiness of this entire so called
investigation. The organization is called the San Diego Independent
Media Center or San Diego Indymedia. This was clearly spelled out in
letter after letter to the city council. This group is not a "protest
group", but, as their website clearly states, a group committed to
"media production and distribution". San Diego Indymedia is a media

Secondly the letter goes on to talk about the ORGANIC Collective,
stating that members of this group have been arrested for engaging in
civil disobedience in the past and starting "breakaway marches". While
I have great respect for the traditions of Martin Luther King Jr. and
Gandhi who have engaged in civil disobedience, I can tell you that this
statement is totally false. The ORGANIC Collective has never engaged in
civil disobedience or "breakaway marches" and no one has ever been
arrested at an ORGANIC Collective event. Nevertheless, this is totally
separate from the complaints which were about the false arrests of
Carly Delso-Saavedra and Janice Jordan, neither of which are members of
the ORGANIC Collective.

The letter also states that the ORGANIC Collective "temporarily took
over an unprotected intersection" at Fourth and Market. This is another
false statement. San Diego Indymedia has video of this event clearly
showing that Fourth and Market was blocked by a huge police barricade
with over 10 police on motorcycle and on foot.

The letter goes on to state that the arrests took place at Fifth and
Market, which is not true. The arrest of Carly Delso-Saavedra took
place at Forth and Market.

Again, the city manager's letter does nothing to respond to the
question of whether or not the arrests were falsely made, instead
trying to paint a picture of the "bad protesters" and justifying the
arrest of innocent people expressing their First Amendent rights.

As my representative, I sincerely hope that you will investigate the
false charges which have been placed on Carly Delso-Saavedra and Janice Jordan, and work to get those charges dropped. In addition, I ask that you investigate the long pattern of the San Diego Police Department of arresting innocent people at political demonstrations and protect
freedom of speech in our city and our country. This affront to the
First Amendment must be stopped if we are to make any claims of being a democracy.
