【About this event】
This event is for anyone interested in cars, Toyota, big-data, hacking, etc.
We are going to provide you with WebAPI which enable you to get big-data about trial cars.
Participants are required to create new idea with WebAPI which we are going to provide.
And participants are going to hack and create new service.
We hope that this event is going to be an opportunity to create new ideas.

  • The event might be cancelled in case the security situation in Israel will see any further escalation.

【Purpose】

The API is within the scope of these terms and conditions made available by TITC free of charge to participants for generating ideas for applications and services across a wide range that involve the use of Vehicle Data with a view to employing Vehicle Data for practical purposes in the future.

【Web API】

“Vehicle Data Web API” provided by Toyota ITC

This WebAPI is the interface to get "Vehicle Data" through our server, such as location by GPS, speed, break, doors, wipers, engine, etc.

*1 Only the vehicle data from trial TOYOTA’s cars can get through this WebAPI.

*2 Operation period of API server is until "end of November 2014".

"Toyota Info Technology Center" is verifying the utilization of Big Data from Toyota’s 100,000 vehicles. We are expecting Israeli engineers to generate the new idea of vehicle data usage in this Hackathon, and can contribute pleasure and social value to society through smartphone applications in the near future.

Terms and Conditions for Participation in the “TOYOTA HackCars Days in Tel Aviv”

Applicants for participation in the TOYOTA HackCars Days in Tel Aviv (hereinafter referred to as the "Hackathon") must accept the following terms and conditions of the TOYOTA InfoTechnology Center (hereinafter referred to as "TITC") when filing an application. Applicants who do not accept the terms and conditions will neither be able to participate in the Hackathon nor use the TITC Vehicle Data Web API (hereinafter referred to as the "API").

  1. Purpose

The API is within the scope of these terms and conditions made available by TITC free of charge to participants for generating ideas for applications and services across a wide range that involve the use of Vehicle Data with a view to employing Vehicle Data for practical purposes in the future.

  1. Intellectual property rights, etc.

(1) Intellectual property rights (meaning patent rights, utility model rights, design rights, copyrights, trademark rights, and other rights stipulated by statute [meaning the Patent Act, Utility Model Act, Design Act, Copyright Act, and Trademark Act] and rights to benefits protected by statute; hereinafter referred to as "Intellectual Property Rights.") that pertain to information, trademarks, images, designs, and any and all copyrights, as well as ideas, know-how, and concepts, etc. (hereinafter referred to as "Ideas, etc.") included in the API belong to TITC.

(2) Intellectual Property Rights and Ideas, etc., concerning services and applications developed using the API belong to the user who is the developer (hereinafter referred to as "User"), except with respect to rights pertaining to API, SDK, or technology, etc., of a third party.

(3) TITC and affiliated companies of TITC can use Intellectual Property Rights concerning services and applications developed using the API free of charge for operating, advertising, and disseminating information about activities such as the provision of the API, etc., as well as for operating, advertising, and disseminating information about TITC and the Hackathon.

(4) Irrespective of the above provisions, TITC and affiliated companies of TITC can engage in negotiations to purchase from Users for a consideration the rights of use for services and applications, etc., developed using the API.

  1. Use of personal information, etc.

(1) Personal information (meaning information that by itself or when readily combined with other information permits identifying individual Users; the same shall apply hereafter) stated in the user applications submitted by Users to TITC for using the API is handled by TITIC in accordance with the privacy policy of TITIC (available for viewing at http://www.toyota-itc.com/en/other/privacy.html). The responsibility for the management of personal information rests with a board director of TITC.

(2) Further to the use for the operations associated with providing the API, subject to the consent of Users, TITC can provide personal information of Users to media organizations and co-sponsoring corporations for press releases and media interviews, etc., and for introductions to co-sponsoring corporations. Moreover, TITIC and affiliated companies of TITC can approach Users to solicit opinions and counsel in connection with the API and the development of applications.

(3) Subject to the consent of Users, TITC can publish the names and corporate affiliations of Users on occasions such as presentations of the activities associated with the provision of the API by TITC and affiliated companies of TITC.

(4) TITC can retain records (such as photographs, videos, and voice recordings, etc.) of the proceedings at the venue of the Hackathon as well as the content of presentations at the said event. Furthermore, subject to the consent of Users, TITC can use and publish the said records through TITC, co-sponsoring corporations, and any media at the discretion of TITC (including, without limitation, Web, newspapers, magazines, and TV, etc.).

  1. Confidentiality

Users must treat as confidential information any non-public information concerning the API disclosed to Users by TITC, except if prior written permission of TITC has been obtained. Furthermore, access information provided Users necessary for using the API and for viewing related documents must be handled in a manner such that none is disclosed or divulged to a third party.

  1. Prohibitions, restrictions, and matters to be observed

With regard to API usage and application development, the following prohibitions, restrictions, and matters to be observed apply.

(1) Applications developed using the API are restricted to experimental provision and publication. Users are requested to inform TITC of the development content when engaging in application development.

(2) Users who make an announcement or formal filing at the Hackathon, or at an application contest, or at other events (including Hackathons unrelated to TITC) concerning an application (including Ideas, etc.) developed using the API are requested to make a concurrent disclosure to the effect that the development was made using the API and to inform TITC that an announcement or formal filing has been made.

(3) Applications developed using the API must not be offered as commercial-use services, whether for a charge or free of charge. Furthermore, also when offered or published on an experimental basis, in-application purchase attributes of development applications are not permitted.

(4) If information queries made by a User of the API continuously extend over long periods of time, the information queries made under the access key provided to the subject User can be restricted or suspended.

(5) Applications (including Ideas, etc.) generated using the API must not be used to commit, or instruct in the commission of, any of the following actions, either in person or through a third party.

(a) Modification, alteration, falsification, replication, deletion, disassembly, decompilation, or such other reverse engineering, of the software or information of the API (including software and information of the response server side), in part or in total

(b) Action that is in contravention to laws and regulations or public order and morals

(c) Action that is unlawful in part or in total

(d) Action that infringes upon Intellectual Property Rights, technological or business knowhow, or other rights of TITC or a third party, or license rights or other rights based on such rights

(e) Usage of the API based on identity theft committed against another User or a third party

(f) Action infringing upon rights of a third party such as privacy rights and reputation, etc.

(g) Other action judged wrongful by TITC

  1. Change of content, scheduled operating hours, limitation of liability, force majeure

(1) The information provided by TITC on the API is subject to change, modification, or deletion without prior notice.

(2) The response server interacting with the API is scheduled to operate in the period from August 23, 2014, until November 30, 2014. During this period, temporary server downtime for maintenance, etc., can occur.

(3) In the event that TITC is liable for damages sustained by Users in connection with the API as a consequence of the use of information provided by TITC, liability of TITC is limited to damages that are both direct and ordinary, unless due to bad faith or gross negligence on the part of TITC.

(4) TITC is not liable for damages that arise from computer viruses that are resistant against standard virus protection measures, damages from natural disaster including seismic events, and damages from other events outside the control of TITC.

(5) TITC can claim indemnity for damages sustained as a consequence of a User's improper use of the API and action committed in contravention to these terms and conditions. Provided, however, that absent bad faith or gross negligence the liability of Users is limited to damages that are both direct and ordinary.

  1. Dispute, governing law, court of jurisdiction

The use the API and the construction and application of these terms and conditions are governed by the laws of Japan. With regard to any dispute that arises in connection with operations for the provision of the API the Tokyo District Court is the court of exclusive jurisdiction in the first instance.
