Citizenship and Executive Overreach: a talk on history and current politics
President Trump issued an executive order hanging birthright citizenship from the meaning it
has had for over century. He’s been accused of exceeding his power and the executive order has
been blocked by the courts. The Supreme Court is set to rule on both issues, birthright
citizenship and executive overreach. But how did we get here? And what significance do these
political controversies have?
Most Americans would be surprised to learn we actually have three different routes for
citizenship: jus soli, jus sanguinis, and social compact theory. And while President Washington
so deferred to Congress that he would not veto bills unless they were unconstitutional,
President Jefferson was ready to exceed his constitutional powers if it were to the obvious
advantage of the United States. We’ll take a look at the checkered history of both citizenship
and executive powers to fit the current conflicts into perspective and see what concerns they
raise for the future.

Brian Bixby has presented to the Economy Club before. He teaches at the Cambridge Center for
Adult Education and holds a Ph.D. in History.
