Jim Francis is a seasoned intellectual property attorney and trusted advisor who helps innovators, entrepreneurs, and growing companies protect what they build. With more than two decades of experience in intellectual property and business law, Jim specializes in strategic risk management, patent and trademark protection, licensing, and dispute resolution. His unique combination of technical and legal expertise allows him to guide startups, universities, and Fortune 100 companies through complex legal challenges while helping them maximize the value of their innovations.
Currently a Partner at Gearhart Law, Jim has built a distinguished career representing clients in high-stakes intellectual property matters, including patent prosecution, IP due diligence, software licensing, and litigation. His work gained national attention when The New York Times featured his role in a landmark trademark dispute involving Kentucky Mist Moonshine and the University of Kentucky. Before entering law, Jim worked in research and engineering roles at Ashland Petroleum and Valvoline, giving him firsthand insight into the innovation process. A published author and recognized thought leader in the life sciences industry, Jim continues to help businesses protect their ideas, reduce risk, and grow with confidence. He works closely with clients to develop practical IP strategies, conduct infringement analyses, and secure meaningful protection for innovations across a wide range of industries, including consumer products, software, electronics, and wireless communication devices.
James also serves as the Patent Executive in Residence at the New Jersey Institute of Technology (NJIT), mentoring entrepreneurs at NJIT’s Enterprise Development Center incubator on a pro bono basis. Known for his collaborative and business-minded approach, he enjoys helping inventors refine and strengthen their ideas while guiding companies through branding and trademark challenges. James earned his undergraduate degree from Cornell College, double majoring in Biochemistry & Molecular Biology and Chemistry, and is passionate about helping innovators turn ideas into protected, marketable assets. David Postolski, Esq. is a senior partner at Gearhart Law, is a registered patent attorney and Intellectual Property (IP) attorney for close to 20 years. David specializes in assisting inventors, creators, artists, start-ups, entrepreneurs, early-stage companies, and emerging companies with their U.S and international IP strategy, protection, enforcement, and monetization. David is a frequent speaker and author on emerging IP issues and technologies including, raising capital, business formation, food science, software, licensing, Data and Privacy Compliance, equity-based crowdfunding, and compliance with other US and International Regulatory structures. David is also a Professor at Temple University, Parsons School of Design and the Radzyner Law School (Herzliya, Israel) where he teaches master-level students about IP, ethics, and other regulatory considerations. David is a current Council Member of the American Bar Association Section of Intellectual Property Law, founder of their International Action Group, and editor of their monthly newsletter, and the outgoing Continuing Legal Education (CLE) Officer.
