Agile contracts

The term "Agile Contracts" has long been considered somewhat of an oxymoron. Given that contracts inherently seek to tie-down every conceivable scenario upfront, is it possible to contract for something upfront which inherently seeks to embrace change? And even if it is possible, how do we do we successfully contract without unduly restricting the advantages and flexibility of Agile principles?

Chris Murphy, Managing Director of ThoughtWorks Australia, is admitted as a solicitor in Australia and England : but as a "recovering lawyer", he asks that you please don't hold that against him. Chris will speak briefly about the rationale for contracts, the barriers to successfully contracting in the Agile space, and explore some example contractual/commercial models for Agile engagements.
