Dear the Haugue workshop participants,

We have landed in Buenos Aires, Argentina and are preparing ourselves for the upcoming Constitutional Convention. We thank you for entrusting us to represent you, as such we would like to update you and request your input.
To begin with, let us summarize some important points of context with regards to the Cardano Constitution process.
General updates

  1. 9 and 10 November in Kenya the Delegate constitutional synthesis workshop took place, Max and Damion participated here and relayed your largest concerns.
  2. 16 November further workshopping which took into account the input from Kenya. You can find the intersect constitution here. This is the version we discussed and worked on in the workshop, and has evolved since.
  3. The Cardano Foundation (CF) has presented a new alternative text for the Cardano Constitution. The CF constitution text differs significantly from the text presented by Intersect. You can find the CF text here. It is certainly a interesting approach that warrants merit, see the blog-post from CF about the differences.
  4. Timeline of ratification has extended. The look as follows as of today:
    a. Constitutional text ratification (intersect version) in Argentina via 51% approval votes by Delegates.
    b. Chang hard fork phase II, will be delayed to the beginning of January.
    c. At the point of phase II of the Chang hard fork the on-chain logic is triggered that allows constitutional text proposals to be ratified – thus becoming the official constitution of Cardano.
  5. The sentiment amongst Delegates seems to predominantly be excitement with an undertone of apprehension (is it good enough?) and practicality (we need to start somewhere).

  6. (+) The constitution has been adapted due to our input. Such as Article VII section I and preamble amongst others.
  7. (~+) Updatability of the constitution itself is and remains a huge concern of Max and Damion. To such extent that during Kenya we, together with Delegates from UK and US petitioned other Delegates to convey this concern to the Civics Committee (responsible for writing the draft constitution). A change to the constitution requires a threshold of 75% of the active voting power – it is to be seen how the Constitution reaches the updates that have often been mentioned as being necessary after the initial years of the Voltaire eta.
  8. (~) The ultimate beneficial owner question of “ADA custodians may not vote without active consent” has somewhat, but not completely, been resolved by Article IV section 2, Max would like to see this the burden on proof for ‘opt-in’ of voting power put on the custodian.
  9. (-) The constitution does not in any way refer to a memorandum of understanding/interpretation as we discussed during the Hague workshop.
  10. (-) There is quite some jargon in the Constitution that could be removed or cut to size. One example is the framing notes. This could be removed or placed to the back of the Constitution.
