Engineers are trained to use technologies to solve problems. They are comfortable with terms like, stress, strain, deflection, buckling, overload protection, conductivity, and human factors. They studied calculus, physics, chemistry, and many subjects specific to their engineering disciplines. Upon entering the working place, they realize there is a whole different world of contracts that affect engineering. The world of written agreements has terminology that may be confusing to read with very specific meanings. It is an arena with phrases like “terms and conditions”, “good faith”, “in breach of”, “hold harmless”, “indemnify and defend”, and “forum non conveniens”. Engineers should have a basic understanding of contracts they are likely to encounter.
Eve Errickson is Pond and Company’s first in-house attorney and General Counsel. Prior to joining Pond in 2022, Eve was lead transactional counsel for the Smithsonian Institution’s Facilities Division from 2015-2022. In that capacity, she advised on acquisition strategy, procurement efforts, awards and contract management for all tiers of contractors and subcontractors providing design, engineering and construction efforts managed by the Smithsonian at sites in the U.S. and abroad, specializing in capital projects valued from $25M to $550M. She is also an expert member of ICOMOS advising on legal, administrative and finance issues affecting internationally significant monuments and sites.
