Details

Notoriously, “Section 28” of the Local Government Act 1988 prohibited schools from teaching that lesbian and gay relationships (now lgbtq+) were “a pretended family”. This was not a measure to promote such relationships as genuine (cf “pretend”), but rather to assert that they could never be any kind of family at all.

Some highlights include Early v Early 1990 SLT 223, T Petitioner 1997 SLT 724, HMA v McKean 1997 JC 32, X v Y [2002] Fam Law 58 (Sh Ct (Glasgow)), the repeal of “Section 28” (2000/2001), the introduction of civil partnerships (2004/2005) and the opening of marriage to same sex couples (2014).
