With everyone having a mobile phone, the use of Surveillance Devices in matters is becoming more and more prevalent. This seminar looks at how the Surveillance Devices Act 2007 (NSW) views clandestine recordings and how you then might take a section 138 objection under the Evidence Act 1995 (NSW) in certain circumstances. It will also examine why practitioners need to be careful when handling illegally obtained surveillance material as there are criminal sanctions that may apply.
