Meeting Overview: How To Profit From Overleveraged Real Estate
Our next monthly meeting is on buying real estate that has little-to-no equity without having to use our own money and/or credit. We will discuss the unconventional technique of buying mortgaged real estate “subject to” all existing mortgages and other liens remaining in place.
Buying “subject to” is a creative real estate strategy where an investor purchases a property while leaving the existing lender’s mortgage and other liens in place. The buyer takes control of the deed and makes the mortgage payments on the seller’s existing loan, but the loan stays in the seller’s name until it’s paid off or refinanced.
Why investors use it
• You can take control of cash-flowing properties with no new financing, or qualifying, required.
• It’s faster than arranging a new loan and can be a useful tool for saving deals where the seller needs a quick exit and/or there is little-to-no equity in the seller’s property.
• It can use a seller’s lower-rate loan (valuable in a rising-rate market).
How it works (simplified)
1. Agree purchase terms with the seller (price, transfer of deed, who pays what).
2. Use a purchase agreement and closing documents that transfer title to the buyer while acknowledging the existing mortgage remains.
3. Buyer begins making the seller’s mortgage payments and manages the property (or re-sells/refinances later).
Who it’s best for
• Investors who want speed, have strong property-management skills, or want to avoid or delay getting new financing.
• Sellers who want a quick exit but keep a clean, fast closing without their potential buyers having to qualifying for a new loan and/or who have mortgaged properties with little-to-no equity in them (this eliminates buying competition from wholesalers, rehabbers, and Realtors).
