Overview: Demystifying Evolving Cyber Law

Cyber attacks continue in 2017 to pose threats to business and critical governmental and private sector infrastructure systems. This the scale of data compromises and magnitude of ransomware and destructive malware, the industry is seeing a dramatic surge in cyber regulation and industry mandates.

However, as it is with evolving legislation, rules will require some interpretation and vetting in the community prior to widespread adoption, but organizations will still be expected to demonstrate diligence with respect to these areas, especially in the wake of a security incident.

The intent of this session is to provide clarity as it pertains to evolving legislation and guidance as it pertains to cyber security at both the state, federal and international levels.

Session 1: Emerging FTC Trends (2:15 – 3:00)

Speaker: Bret Cohen – Partner - Hogan Lovells US LLP

Bio: Bret Cohen helps technology and brick-and-mortar businesses comply with privacy, cybersecurity, Internet, and consumer protection laws. He also represents companies in litigation and government investigations in these areas. As a lawyer and technologist, Bret has a knack for translating legal standards into practical technical requirements that are easy for clients to use.

With a particular focus on the Internet and e-commerce, Bret has advised extensively on legal issues related to cloud computing, social media, mobile applications, online tracking and analytics, and software development. He counsels and is a frequent speaker on strategic compliance with global privacy laws, including cross-border transfer restrictions, data localization requirements, and the impact of government surveillance on the digital economy. Bret also spearheads efforts on cybersecurity incident preparedness and response, student privacy, marketing privacy, and workplace privacy.

Session 2: U S and the EU – The Present and Future of Breach Notification Laws (3:00 – 3:45)

Speaker: Paul Gupta - Partner, ReedSmith

Bio: As stated in Chambers USA: America's Leading Lawyers for Business, Paul "litigates cases involving hi-tech electronic, software and internet-related patents." Chambers USA added that he is “an expert in cybersecurity.” His clients include industry leaders in e-commerce, IT, financial services and telecom.

Paul, according to Chambers USA, is "a zealous advocate for his clients," "praised as a great negotiator” and “a strong strategist,” “renowned for his work in the technology arena" and "extraordinarily accessible." He is also listed as a notable lawyer in Super Lawyers and in IAM’s "World's Leading Patent Practitioners."

He regularly handles intellectual property litigation (including patent, copyright, trademark and trade secret cases), as well as commercial litigation (including cybersecurity, licensing, outsourcing and indemnity cases).

He is currently or has recently been lead counsel in Federal District Court actions and arbitrations pending in California, Delaware, Illinois, Kansas, Massachusetts, New Jersey, New York, Tennessee, Texas and Virginia. He also counsels clients throughout the United States on a variety of technology law matters

Session 3: NYS Cyber Security Law – What You Need to Know (4:15 – 5:00)

Speaker: Jim Ambrosini, CohnReznick

Bio: During his twenty-year career, Jim has worked in various roles at leading companies, including: Application Development, Systems Analyst and Programmer, Internal Audit, Risk Management, Cybersecurity, IT Consulting, and Public Accounting. He now focuses on cybersecurity and technology risk and governance.

He is a frequent public speaker at national and firm-sponsored conferences on the topics of Cybersecurity and Emerging Technology Trends.

He has served on the ISACA International task force for emerging business technologies and had previously been selected as the ISACA International Vice President, after serving as the President of the New York ISACA Chapter. He is also a member of the Cybersecurity Task Force for the US Chamber of Commerce.
