Kathleen Smith Executive Director for the State Board of Education stated “Per SB260 signed into law by Gov. Carney on August 2/24, SBE no longer oversees any DIAA rules or regulations”. It doesn't say that but ok? Senator Nicole Poore disbanded the DIAA board of directors based on the unethical politically biased testimony of my fellow Rules and Regulations committee members and Athletic Directors. Dave Baylor went from a collaborative ED to unlimited power. Now the ADs are writing rules not the board or General Assembly. My committee chair Mark Robinson AD St Georges unethically blocked regulations that would make Delaware compliant with state and federal law. All this was done to stop anyone that does not conform with their birth assignment.
Last year the only thing an athlete needed in Delaware to compete was a drivers license and a physical. This year you must surrender all of your HIPAA information to a state cop in charge of a private association. All Delaware Interscholastic Athletic Associations member schools are now required to pay millions and will now be required to provide equal accommodation for every gender identity you collect. The solution would be to honor the vote of the former 22 member DIAA board and eliminate minimum standards for athletes who may be incongruent with their birth assignment. They also voted to return access to Title IX protections taken from parents and students. Dave Baylor DSP refused to honor the vote of the previous board and imposed an invasive application.
The rationale given for the new Emergency Medical Application is not based on reality. In 2021 Michael Rodriguez (principle ASPIRA) and Dr. Bradley Layfield (disgraced principal Sussex Central) introduced a senate task force. The purpose was “to promote fair competition, healthy lifestyles, sportsmanship and ethical behavior. The unstated goal was the elimination and eradication of gender diverse children. These children are not the ones acting unethically, unsportsman like and without integrity. Dave Baylor and Mike Rodriquez and the rules and regs committee are the ones acting unethically and without integrity.
I served on the DIAA Rules and Regulations committee and have 84 hours of state mandated ethics training. Ethical behavior was not what I witnessed from my committee. The healthy lifestyles they refer to are those that conform to a birth assignment on the Christian right and sexual orientation movement on “LGBTQ” left. Even women wishing to compete must have a waiver if a women's option is available. All athletes that do not conform to their birth assignment must receive a waiver Cape administration and Governor Meyers use acronyms like this to allow the Democrats to burry gender/biodiverse student issues under the LGB political agenda. Governor Meyers said it was up to member schools. It is not.
I will provide a list of DIAA board members and politicians related to the senate task force. We will talk about the need for a gender and biodiversity commission. We hope to start an education foundation to bring Delaware up to date on current health standards and the needed equality the the Governors LGBTQ commission will not allow. Last we will talk about ongoing education efforts and why it is important that Delaware bring the 301 education that Congresswoman McBride said we need.
