PHONE RECEPTION. HE SAID HE AND FRIENDS WERE RIDING BIKES ALONG 
NARROW SHOULDER WHEN LV CAME UP BEHIND THE, SLOWED, AND STARTED 
HONKING HORN. ICI SAID ELDERLY DRIVER APPARENTLY BECAME 
FRUSTRATED AND THEN DROVE UP BEDISE THEM, YElED AT THEM ABOUT 
"BLOCKING HIS ROAD" THEN WHEN HE GOT AROUND THEM, STOPPED IN FRONT 
OF THEM. ICI SAID HE AND DRIVER "EXCHANGED" WORDS, GETIING INTO A 
VERBAL ARGUMENT./CI SAID DRIVER THEN WAS DRIVING AWAY BEFORE HE 
WAS OUT OF WAY, KOCKING HIM OFF HIS BIKE, CAUSING DAMAGE./CI SAID HE

Summary: 

On the above date and time I was on duty in the North District ofMarion County with 
Deputy Tom Crofts. I received a call of a hit and run accident on Champoeg Road. The 
call was of a bicyclist who was struck by a motorist, and refusing medics. Deputy 
Brewster made phone contact with the victim, (Kevin), who gave a brief

statement to Deputy Brewster over the phone. (Kevin) informed Brewster he was going 
to continue his ride and would call MCSO when he returned to the store in Butteville.

On the afternoon of[masked]met with Thomas xxxxxxxxxxx to gather his statement and 

also spoke with his wife later in the afternoon. I spoke with (Kevin), who told he 

did not want to settle things and would like to see (the driver) charged. 

1 spoke with Brendan Murphy, a Marion County Deputy District Attorney, who advised 
me of possible options, and said to place his name on the case. 

(Kevin's) statement was different from (Thomas'). (Kevin) admitted to 

striking (Thomas') mirror, and causing more than $100 dollars in damage. This is 

confirmed by the statements of all other parties involved. (Thomas) admitted to 

striking (Kevin's)  bicycle, then driving away form the scene and not reporting the 

incident. This is conformed by the statements of the other parties involved. 

On[masked] at about 0930 hours 1met Thomas xxxxx at the Shell gas station, West of 
1-5and Newberg Rd. 1cited and released Mr. xxxxxx on the above charge. (Thomas) 
also showed me a damage estimate for $235 for the repair to his vehicle. Later that day 
at about 1350 hours 1 met with (Kevin) at the Starbucks West ofI-5 and Chemawa 
RD. 1cited and released xxxxxxxx for the above listed charge. 

Statements: 

Kevin xxxxxxxxxxxxx: 

(Kevin) told me he was riding on Champoeg Road, along the fog line, because there 
was not much of a shoulder. Then a vehicle approached him from behind and began to 
honk. The vehicle passed (Kevin) at an arms length or less. After the vehicle was 
about 60 yards passed, (Kevin)  signaled for the vehicle to stop and return to where 
the cyclists were. (Kevin) said he was not happy with how close the vehicle had 
come to him while passing, and wanted to speak about the incident with (the driver). The 
vehicle, driven by (Thomas), came towards him in reverse at a high rate of speed 
eventually stopping at the passenger door. As (Kevin) began to talk (the driver) 
yelled something to the effect ofifI see you on this road again 1 will run you over. (Kevin) 
said he intentionally hit the passenger side mirror of the vehicle, with the intent 
to "break it off' so the driver would report the incident to the police and they would be 
forced to speak about it later. After this happened the vehicle backed up then drove 
forward towards (Kevin)  hitting him while on his bicycle with the front passenger 
side headlight. (Kevin) said he then fell to the ground injuring his ankle and 
causing damage to his bicycle. Someone then called 911.

(Kevin) said the bike had a broken reflector on the front tire, and the tire was no 
longer straight, however he was able to finish his bike ride. He estimated the damage at 
about $110. (Kevin) said he had some pain to his right ankle, which had some 
abrasions. (Kevin) said after reporting the event he completed his bike ride of35 
miles. 

Elise xxxxxxx:

(Elise) was a few cyclists behind (Kevin), at the time ofthe incident. (Elise) 
said they were riding on Champoeg Road, on the fog line when a vehicle approached and 
honked for an extended period oftime. The vehicle then passed the cyclists at a good 
distance in the other lane oftraffic, (Thomas) got closer to (Kevin) as they entered 
a corner (about 2 feet from (Kevin)). As the vehicle passed them the driver yelled, 
"Get offthe road." (Kevin) then waved to the vehicle, which stopped and backed 
up so the passenger door was even with (Kevin). (Elise) said there was a verbal 
argument in which the person in the vehicle yelled something to the effect ofnext time I 
see you on this road I will hit you. (Kevin) struck the passenger side mirror of the 
vehicle causing damage. Then (Kevin) walked off towards the ditch to the right. 
The vehicle went forward striking (Kevin's) bike. 

Luis XXXXXXXXX: 

(Luis) stated he was riding on Champoeg Road with a group ofriders when a 
vehicle passed him and honked the hom loudly. (Kevin) waved his had at the 
vehicle. (Luis) was not sure ofthe exact motion. (Thomas) returned to where 
the bikers were now standing. (Thomas) started yelling at (Kevin) saying 
something to the effect of next time I'll just run you off the road. (Kevin) struck the 
mirror causing the reflective portion to fall from the mounting and dangle by the cord. 
(Kevin) started to walk away from the vehicle with his bicycle. (Thomas) drove 
the vehicle in reverse, then after a short distance put it back in forward turning the wheels 
towards (Kevin) and striking (Kevin's) bicycle. This caused the bicycle to go 
to the ground. (Luis) stated (Kevin) then fell over the front of the bicycle. 
When the bicycle fell (Thomas) drove away. 

Dave xxxxxxxxx: 

(Dave) stated he was riding with a group of cyclists on Champoeg Road. He was 
riding on the right fog line. A vehicle, driven by (Thomas), began honking and passed 
them at a very close distance. (Kevin) waved his had at the vehicle. He was not 
sure ofthe exact motion. The vehicle went into reverse and returned to where the bikers 
were standing. When the vehicle stopped the passenger door was even with (Kevin).
(Thomas) began to yelling something to the effect of stay of my fxxxing 
road, ifI see you on this road again I will run you over. (Kevin) was yelling back, 
when he struck the passenger side rearview mirror of the vehicle, causing damage. (Kevin)
 then began to walk away from the vehicle, with his bike in his hand, when the 
vehicle went in reverse for short distance, stopped, then pointed the wheels at

(Kevin)  and drove forward striking the back tire of (Kevin's) bicycle. The bicycle 
fell on top of (Kevin), knocking him over. (Thomas) then drove off. 



(Thomas) stated he was westbound on Champoeg Road when he saw a group of cyclists 
ahead. The first few were on the right shoulder and the lead cyclist, later identified as 
(Kevin), was in the middle of the westbound lane of traffic. (Thomas) honked his 
horn to signal for the (Kevin) to move over, and he did not. (Thomas) then passed 
(Kevin)  in the eastbound lane of traffic. As he did this (Kevin) attempted to 
reach out and hit (Thomas') car as he drove by. Once (Thomas) was ahead of the 
cyclists (Kevin) flipped him off, and signaled for him to come back. (Thomas) 
said he put the car in reverse and returned to the cyclists. The two then got into a verbal 
argument. (Kevin) was standing next to his passenger window holding his bike by 
the handlebars. (Kevin) said something to the effect of we have as much right to 
the road as you do. (Thomas) said something to the effect of that's true, but you 
shouldn't be in the middle of the road, you are going to get hit. Soon after that(Kevin)
smacked the mirror with his hand causing the mirror portion to dangle by a cord 
and the plastic portion to separate from the doorframe. (Thomas) said, out of sheer 
reaction, he turned the wheels to the right and hit the back tire of (Kevin's) bike 
with the front right portion ofhis vehicle. This caused the bicycle to fall to the ground. 
(Kevin) did not let go of the handlebar and fell over the front tire of the bike. (Kevin)
 then stood up and began to yell at him, along with the other cyclists. (Thomas)
 said he did not stay because (Kevin) appeared all right. He said due to the 
reaction and yelling by (Kevin) and the other cyclists he drove away to avoid 
further conflict. He said he did not report the incident because he felt (Kevin) 
would later calm down and not report the incident. (Thomas) added he would like to 
settle things with out pressing charges. 

Teresa xxxxxxxxx: 

Mrs.xxxxxxxx told me they were driving down the road when she saw some bikers in front 
of them. All of them were over to the right hand side except for one who was in the 
middle of their lane, who was later identified as (Kevin). (Thomas) honked his 
hom for (Kevin) to move, and he did not. As they passed (Kevin) in the 
oncoming lane (Kevin) turned to the left towards us and swung his left arm at the 
vehicle, which caused (Teresa) to scream. The next thing Mrs. xxxxxxx remembers 
was the vehicle traveling back towards the bikers. (Kevin) was standing next to his 
bike by the front right tire. There was a verbal argument, and Mrs. xxxxxx herd some of 
the other bikers in the background yelling at (Kevin) to settle down and leave it 
alone. Then (Kevin) swung at the mirror, breaking it. (Kevin) then began to 
walk away. (Thomas) hit the back tire of (Kevin's) bike with the front right 
p0r:tion of the car. (Teresa) told me she was scared and shocked by (Kevin's) 

actIons. 

Disposition: Case closed by arrest.
