1 Participation & Health │ Teilnahme & Gesundheit
EN
I participate entirely at my own risk, confirm that I am medically fit and will follow traffic rules and crew instructions.

2 Liability │ Haftung

Participation and Assumption of Risk
Participation is entirely at the participant’s own risk. The typical hazards of outdoor running (falls, weather, traffic) are knowingly accepted.
Organizer’s Limited Duty of Care
The Organizer is obliged only to exercise reasonable care in route selection and group coordination; no guarantee is given that the route is free from all hazards.
Exclusion of Liability for Simple Negligence
The Organizer shall not be liable for damage caused by simple negligence unless a material contractual duty is breached.
Non-waivable Liability
Liability for intent, gross negligence, and injury to life, body or health remains unlimited.
Property and Financial Loss
The Organizer accepts no liability for loss of or damage to personal belongings, nor for pure financial loss, except in cases of intent or gross negligence.
Indemnity
Participants shall indemnify and hold the Organizer and all assistants harmless from any third-party claims arising from their own conduct.
Participant Obligations
a) Medical fitness confirmed by a physician.
b) Adequate private accident and liability insurance.
c) Compliance with German traffic regulations, route instructions, visibility measures (e.g. reflectors) and no headphones on both ears.
Minors
Participation is permitted only with written consent of a legal guardian.
Limitation Cap
For any remaining liability under sections “Exclusion of Liability for Simple Negligence” and “Property and Financial Loss,” compensation is limited to € 100 per incident, representing the foreseeable, contract-typical loss.

Teilnahme & Risikoübernahme
Die Teilnahme erfolgt ausschließlich auf eigene Gefahr. Die üblichen Gefahren des Laufens im Freien (Sturz, Witterung, Verkehr) werden bewusst in Kauf genommen.
Beschränkte Sorgfaltspflicht des Veranstalters
Der Veranstalter schuldet nur die sorgfältige Auswahl der Strecke und die Koordination der Gruppe; eine Gewähr für völlige Gefahrlosigkeit besteht nicht.
Ausschluss einfacher Fahrlässigkeit
Der Veranstalter haftet für Schäden aus einfacher Fahrlässigkeit nur bei Verletzung wesentlicher Vertragspflichten.
Unabdingbare Haftung
Für Vorsatz, grobe Fahrlässigkeit sowie für Schäden an Leben, Körper oder Gesundheit bleibt die Haftung unbeschränkt.
Sach- und Vermögensschäden
Für Verlust oder Beschädigung persönlicher Gegenstände sowie für reine Vermögensschäden haftet der Veranstalter – außer bei Vorsatz oder grober Fahrlässigkeit – nicht.
Freistellung
Teilnehmende stellen den Veranstalter und alle Helfenden von Ansprüchen Dritter frei, die auf ihrem eigenen Verhalten beruhen.
Mitwirkungspflichten der Teilnehmenden
a) Ärztliche Bestätigung der Sporttauglichkeit.
b) Vorhandensein einer ausreichenden privaten Unfall- und Haftpflichtversicherung.
c) Beachtung der deutschen Verkehrsregeln, der Streckenhinweise, Sichtbarkeitsmaßnahmen (z. B. Reflektoren) und Verbot von Kopfhörern auf beiden Ohren.
Minderjährige
Minderjährige dürfen nur mit schriftlicher Einwilligung eines gesetzlichen Vertreters teilnehmen.
Haftungsdeckel
Für verbleibende Haftung gemäß “Ausschluss einfacher Fahrlässigkeit” und “Sach- und Vermögensschäden” ist der Schadensersatz auf 100 € je Vorfall begrenzt, was den vertragstypisch vorhersehbaren Schaden abbildet.

3.1 Capture │ Aufnahme
